Driver First Rental provides vehicle rental services, including vehicles intended for eligible rideshare and gig-economy drivers.

By accessing our Website, submitting an application or inquiry, making a reservation, communicating with us, or using our services, you agree to these Terms.

If you do not agree with these Terms, please do not use the Website or our services.

1. Our Services

Driver First Rental provides vehicle rental services for eligible customers, including individuals seeking vehicles for rideshare and gig-economy driving.

Our services may include vehicles suitable for use with third-party platforms such as Uber, Lyft, DoorDash, and other rideshare or delivery services, subject to the requirements of those platforms and the terms of your individual rental agreement.

Availability of vehicles, pricing, rental periods, deposits, insurance arrangements, mileage allowances, eligibility requirements, and other rental terms may vary.

Information displayed on our Website is provided for general informational purposes and does not guarantee vehicle availability or approval for a rental.

2. Independent Business / Third-Party Platforms

Driver First Rental is an independent vehicle rental company.

Unless expressly stated otherwise, Driver First Rental is not owned, operated, sponsored, endorsed, or administered by Uber, Lyft, DoorDash, or any other rideshare, delivery, transportation, or gig-economy platform.

All third-party company names, trademarks, and logos belong to their respective owners.

You are responsible for determining whether a particular vehicle and rental arrangement satisfy the current requirements of any third-party platform on which you intend to drive.

Platform requirements may change at any time.

Driver First Rental does not guarantee that:

• You will be accepted or remain approved by Uber, Lyft, DoorDash, or another platform;

• A particular vehicle will qualify for every platform, service level, or market;

• Your platform account will remain active;

• You will receive any particular number of trips, deliveries, or customers; or

• You will earn any specific amount of income.

3. Rental Eligibility

Renting a vehicle from Driver First Rental may require you to satisfy eligibility requirements established by Driver First Rental, our insurers, applicable law, and/or other relevant parties.

Requirements may include, where applicable:

• A valid driver's license;

• Satisfactory identity verification;

• Meeting applicable minimum age requirements;

• Providing accurate contact information;

• Providing a valid payment method;

• Meeting insurance requirements;

• Satisfying applicable driving-record requirements;

• Signing a Vehicle Rental Agreement;

• Paying required rental charges and deposits; and

• Providing other documentation reasonably required to verify rental eligibility.

Meeting preliminary eligibility requirements does not guarantee approval or vehicle availability.

Driver First Rental reserves the right to approve or decline a rental as permitted by applicable law.

4. Vehicle Availability

All vehicles are subject to availability.

Photos, descriptions, features, colors, model years, and other vehicle information displayed on the Website are intended to provide general information.

The exact vehicle shown online may not always be available.

We may substitute, remove, add, or change available vehicles without notice.

A website inquiry or application does not by itself guarantee that a vehicle has been reserved for you.

5. Pricing and Fees

Rental rates displayed or advertised on the Website are subject to applicable terms, qualifications, vehicle availability, and your Vehicle Rental Agreement.

Additional charges may apply, including where applicable:

• Security deposits;

• Taxes;

• Late fees;

• Extension charges;

• Additional mileage charges;

• Tolls;

• Parking tickets;

• Traffic or administrative violations;

• Cleaning charges;

• Smoking-related charges;

• Fuel or charging costs;

• Damage charges;

• Lost key or key replacement charges;

• Towing or recovery expenses;

• Administrative fees; and

• Other charges permitted under your Rental Agreement and applicable law.

The final terms and charges applicable to a rental will be stated in or governed by your Vehicle Rental Agreement.

6. Security Deposits

Driver First Rental may require a security deposit before releasing a vehicle.

The amount and terms of the deposit may vary based on the vehicle, rental arrangement, payment method, or other applicable factors.

Security deposits may be applied toward unpaid amounts permitted under the Rental Agreement, including rental charges, damage, excessive cleaning, missing equipment, tolls, tickets, late charges, or other amounts owed.

Any refundable balance will be handled according to the Rental Agreement and applicable law.

7. Payments

You agree to provide accurate and authorized payment information.

By providing a payment method in connection with a rental, you authorize Driver First Rental and its payment processors to process charges that you authorize or that become due under your applicable agreements, subject to applicable law.

Payment processing may be performed by third-party payment providers.

Your use of a third-party payment service may also be subject to that provider's terms and privacy practices.

8. Vehicle Rental Agreement

These Website Terms are not a substitute for your Vehicle Rental Agreement.

Before receiving a vehicle, renters may be required to execute a separate Vehicle Rental Agreement.

That agreement may establish additional terms concerning:

• Rental rates and payment schedules;

• Rental duration;

• Vehicle pickup and return;

• Security deposits;

• Authorized drivers;

• Mileage;

• Maintenance;

• Insurance;

• Accidents;

• Vehicle damage;

• Tolls and violations;

• Prohibited uses;

• Smoking;

• Pets;

• Cleaning;

• Vehicle location or telematics technology;

• Late payments;

• Late returns;

• Vehicle recovery;

• Termination; and

• Other rental-specific obligations.

If these Website Terms conflict with a signed Vehicle Rental Agreement concerning your specific vehicle rental, the Vehicle Rental Agreement will control with respect to that rental, to the extent permitted by law.

9. Authorized Drivers

Only individuals expressly authorized under the applicable Vehicle Rental Agreement may operate a Driver First Rental vehicle.

You may not permit another person to operate the vehicle unless that person has been approved and authorized as required by Driver First Rental.

Allowing an unauthorized driver to operate a rental vehicle may constitute a violation of your Rental Agreement.

10. Rideshare and Delivery Use

If a vehicle is rented for rideshare or delivery purposes, you are responsible for maintaining any accounts, approvals, licenses, documentation, and qualifications required by the platform you use.

Driver First Rental does not control third-party platform decisions.

Uber, Lyft, DoorDash, and similar companies may independently change their:

• Vehicle eligibility requirements;

• Driver requirements;

• Insurance requirements;

• Vehicle-age requirements;

• Inspection requirements;

• Geographic restrictions;

• Account policies; and

• Other rules.

You are responsible for complying with the requirements applicable to your platform account and activities.

11. No Earnings Guarantee

Driver First Rental provides vehicle rental services.

We do not guarantee employment, rideshare approval, customers, trips, deliveries, revenue, profits, or earnings.

Your earnings may depend on numerous factors outside our control, including your hours worked, location, demand, platform policies, customer activity, expenses, driving history, and market conditions.

Any earnings examples or statements appearing in marketing materials are illustrative only unless expressly stated otherwise and should not be interpreted as a guarantee of future income.

12. Insurance

Insurance requirements and coverage applicable to a rental will be governed by the applicable insurance policy, Rental Agreement, platform requirements, and applicable law.

You are responsible for understanding what coverage applies while using a rental vehicle.

Rideshare and delivery platforms may provide different insurance coverage depending on whether an app is offline, online, waiting for a request, traveling to a passenger/customer, or completing a trip or delivery.

Nothing on our Website should be interpreted as a guarantee that insurance will cover every accident, claim, loss, driver, activity, or circumstance.

Refer to your Rental Agreement and applicable insurance documentation for specific coverage information.

13. Accidents, Damage, Theft and Vehicle Problems

If a rental vehicle is involved in an accident, damaged, stolen, vandalized, disabled, or otherwise experiences a significant problem, you must follow the reporting procedures contained in your Vehicle Rental Agreement.

Where appropriate, this may include immediately contacting:

• Emergency services;

• Law enforcement;

• Driver First Rental;

• The applicable insurance provider; and/or

• The applicable rideshare or delivery platform.

You must not intentionally conceal damage, accidents, theft, or other reportable incidents involving a rental vehicle.

14. Tickets, Tolls and Violations

Unless otherwise stated in your Rental Agreement, renters are responsible for tolls, parking charges, traffic tickets, citations, impound fees, and other violations or charges arising from their possession or operation of a rental vehicle.

Driver First Rental may charge applicable administrative or processing fees where permitted by the Rental Agreement and applicable law.

15. Vehicle Condition and Proper Use

You agree to use rental vehicles responsibly and in accordance with:

• Applicable laws;

• Manufacturer requirements;

• Your Vehicle Rental Agreement;

• Applicable insurance requirements; and

• Reasonable vehicle-safety practices.

Prohibited vehicle uses will be specified in the applicable Rental Agreement and may include unlawful use, reckless driving, racing, towing without authorization, operation by unauthorized drivers, or other misuse.

16. GPS and Vehicle Telematics

Certain Driver First Rental vehicles may be equipped with GPS, telematics, anti-theft, diagnostic, or vehicle-management technology.

Where installed and permitted by applicable law, these systems may provide information such as vehicle location, mileage, vehicle status, diagnostic information, and other vehicle-related information.

Such systems may be used for legitimate purposes including:

• Vehicle security;

• Theft prevention;

• Vehicle recovery;

• Maintenance;

• Roadside assistance;

• Fleet management;

• Investigating suspected fraud or misuse; and

• Enforcing applicable rental obligations.

17. Website Accounts, Applications and Forms

When submitting information through our Website, you agree to provide information that is accurate, current, and complete.

Consent to receive marketing text messages is not a condition of purchasing or renting services unless otherwise permitted by applicable law.

SMS opt-in consent and mobile information will not be sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

Your existing Cottman terms use the same basic STOP/HELP approach for SMS communications.

19. Intellectual Property

Unless otherwise stated, the Website and its original content, including text, graphics, logos, photographs, design elements, and other materials owned by Driver First Rental are protected by applicable intellectual-property laws.

You may use the Website for your personal, non-commercial interaction with Driver First Rental.

You may not reproduce, distribute, modify, sell, republish, or commercially exploit our protected Website content without authorization.

Third-party trademarks and logos remain the property of their respective owners.

20. Third-Party Websites

Our Website may contain links to third-party websites or services.

Driver First Rental does not control those websites and is not responsible for their content, availability, security, terms, or privacy practices.

Your interactions with third-party services are governed by the terms and policies of those third parties.

21. Website Information and Disclaimer

Vehicle availability, pricing, eligibility requirements, features, promotions, and other information may change.

Your signed Rental Agreement governs the specific terms of an actual rental.

22. Limitation of Liability

To the fullest extent permitted by applicable law, Driver First Rental and its owners, employees, agents, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from your use of or inability to use the Website.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Specific responsibilities and liabilities concerning a rental vehicle are governed by the applicable Vehicle Rental Agreement and applicable law.

23. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims, damages, costs, or expenses resulting from your unlawful use of the Website, violation of these Terms, or violation of another person's rights.

Vehicle-related indemnification obligations, if any, will be governed separately by your Vehicle Rental Agreement and applicable law.

24. Privacy

Your use of the Website and our handling of personal information are also governed by our Privacy Policy.

Please review the Privacy Policy before submitting personal information through the Website.

Your Cottman policy already distinguishes personal information collected directly from customers, automatically through website activity, and through service providers. Driver First Rental's Privacy Policy should retain that distinction while reflecting the information actually collected for rentals.

25. Termination and Suspension

We may restrict or terminate access to our Website or services when reasonably necessary, including in cases involving:

• Fraud or suspected fraud;

• Misrepresentation;

• Nonpayment;

• Unauthorized vehicle use;

• Material violations of these Terms;

• Material violations of a Rental Agreement;

• Threats to vehicle or public safety; or

• Unlawful activity.

Termination of a vehicle rental will be governed by the applicable Rental Agreement and applicable law.

26. Governing Law

These Terms will be governed by the laws applicable in the Commonwealth of Pennsylvania, without regard to conflict-of-law principles, except where another law is required to apply.

Any dispute concerning a specific vehicle rental may also be governed by the dispute-resolution provisions contained in the applicable Vehicle Rental Agreement.

27. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, Website, business practices, or legal requirements.

When changes are made, the "Last Updated" date at the top of this page will be revised.

Your continued use of the Website following an update constitutes acceptance of the revised Terms to the extent permitted by law.

28. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

29. Entire Website Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated into them, constitute the agreement concerning your use of the Driver First Rental Website.

A separately executed Vehicle Rental Agreement governs the terms of an actual vehicle rental.
